This article observes the instance of legislation and doctrine about the definition of obligation in the continental law system,proves that the essence of obligation is the right to accept performance but not to claim performance,and then gives a deliberation on the definition of obligation in the proposal draft of China civil law.
考察了大陆法系国家关于债的定义的立法例和学说,主张债的本质是给付受领权而不是给付请求权,在此基础上,对我国民法典草案建议稿中的债的定义进行评述,并提出自己的看法。
